Terms and Conditions of Open Airway GmbH

1. Contracting Parties & Scope
These Terms and Conditions apply between Open Airway GmbH, Johannisbollwerk 19, 20459 Hamburg (“Provider”) and the participant (“Customer”) for all training and service offerings; other terms and conditions of the Customer are not recognized. A contract is concluded through written registration by the Customer (e.g., email, online form) and acceptance by the Provider via confirmation. All prices are subject to the statutory value-added tax (VAT). For online registrations, payment is due immediately upon completion of the booking, optionally via credit card, PayPal, or Sofort (depending on the payment method offered). The events take place at the specified times and locations.

2. Conclusion of Contract
A contract is concluded through written registration by the Customer (e.g., email, online form) and acceptance by the Provider via confirmation.

3. Prices & Payment
All prices are subject to the statutory value-added tax (VAT). For online registrations, payment is due immediately upon completion of the booking, optionally via credit card, PayPal, or Sofort (depending on the payment method offered).

4. Provision of Services
The events take place at the specified times and locations.

5. Cancellation & Substitute Participants
The Customer may withdraw in writing up to 60 days before the event. Naming a substitute participant is possible.

6. Liability & Warranty
Should any identifiable defects occur after the provision of services, we request written notification within 7 days. Open Airway GmbH reserves the right to rectify the defect or refuse the service at its own discretion. Liability for slight negligence is limited to foreseeable damage typical for the contract. There is no liability for consequential economic loss, in particular lost profits.

7. Cancellation by the Provider
The Provider reserves the right to cancel or reschedule events for important reasons—e.g., illness of the lecturer, force majeure, or failure to reach the minimum number of participants. In the event of a cancellation, any participation fees already paid will be fully refunded. Further claims, in particular for damages, do not exist. Personal data of the Customer will be processed in compliance with the GDPR.

8. Copyright of Training Materials
The training materials and digital content provided to the Customer are subject to copyright and may be used exclusively for personal use. Any transfer, reproduction, or publication—in whole or in part—is not permitted without the express written consent of the Provider.

9. Image Rights
By registering for the event, the participant consents to the use of photo and film recordings made of them during the event for editorial purposes and for the organizer’s own advertising (even after the end of the event). This includes, in particular, recordings of speakers, discussions, and audience scenes.

10. Jurisdiction & Law
German law shall apply. The place of jurisdiction is Hamburg.

11. Severability Clause
Should any provision of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The provision in question shall be replaced by a valid one that comes closest to the intended meaning and economic purpose.
